Terms of Service.

Please read these comprehensive terms carefully. By using PromptingImage, you are entering into a legally binding agreement governing your use of our neural vision systems.

1. Acceptance of Agreement

By accessing, browsing, or otherwise using the PromptingImage platform (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. This document constitutes a binding legal agreement between you ("User") and PromptingImage. If you are using the Service on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these terms.

2. Scope of Service

PromptingImage provides access to multimodal neural networks designed to interpret visual data from images and Portable Document Formats (PDFs). The service includes, but is not limited to: automated image captioning, metadata generation, optical character recognition (OCR), and prompt enhancement algorithms. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time without prior notice.

3. AI-Specific Disclaimers

The User acknowledges that the Service utilizes advanced Artificial Intelligence and Machine Learning models. Due to the probabilistic nature of these systems:

  • Accuracy: Captions and extracted text may contain factual errors, biases, or "hallucinations" (content that does not exist in the original image).
  • Subjectivity: Descriptive outputs are subjective interpretations and may vary based on model versioning and probabilistic sampling.
  • No Professional Advice: AI-generated content should not be used for medical, legal, financial, or safety-critical decisions.

4. User Eligibility & Conduct

You must be at least 13 years of age (or the minimum legal age in your jurisdiction) to use this Service. By using PromptingImage, you agree to adhere to the following Code of Conduct:

  • No automated scraping or bulk harvesting of AI outputs via scripts or bots.
  • No reverse engineering of the Service's underlying architecture or API protocols.
  • No use of the Service to generate content that is defamatory, obscene, or promotes violence.
  • No attempting to bypass system rate limits or security measures.

5. Data Ownership & Intellectual Property

Your Content (Inputs)

You retain all ownership rights to the images and documents you upload. You grant PromptingImage a transient, non-exclusive license to process your content solely for generating the requested output. We do not use your inputs for general model training unless explicitly opted-in.

AI Content (Outputs)

As between you and PromptingImage, you own the text outputs generated by the Service. However, due to the nature of AI, similar inputs from other users may generate identical or similar outputs; you do not have exclusive rights to such generic or repetitive outputs.

6. Content Restrictions

Users are strictly prohibited from uploading images or documents that contain:

  • Child Sexual Abuse Material (CSAM) or any content depicting non-consensual sexual acts.
  • Highly sensitive personal identifiable information (PII) of third parties without consent.
  • Malicious code, viruses, or any content designed to disrupt the Service's infrastructure.
  • Proprietary or confidential information that you do not have the legal right to share.

7. Fees & Commercial Use

The Service is currently provided free of charge for reasonable individual use. PromptingImage reserves the right to introduce subscription tiers, per-use fees, or advertising-supported models at any time. Commercial usage of the Service's free tier is permitted but subject to strict rate limits to ensure equitable access for all users.

8. Data Privacy & Processing

Your privacy is governed by our Privacy Policy. All image processing occurs in transient memory. While we do not store your images, logs of technical metadata (e.g., timestamp, file size, processing duration) may be kept for service optimization and security auditing purposes.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." CAPTIONAI EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAPTIONAI AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

11. Indemnification

You agree to indemnify and hold harmless PromptingImage, its officers, directors, and employees from any claims, damages, liabilities, and expenses (including attorneys' fees) arising out of your use of the Service, your violation of these terms, or your infringement of any third-party rights through the content you upload.

12. Governing Law & Jurisdiction

These Terms shall be governed by the laws of the jurisdiction in which PromptingImage is headquartered, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in that jurisdiction, and the parties hereby irrevocably consent to the personal jurisdiction and venue therein.

13. Severability & Entire Agreement

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect. These Terms constitute the entire agreement between you and PromptingImage regarding the use of the Service.

14. Modifications

PromptingImage reserves the right to revise these Terms at any time by posting the updated version on this page. Your continued use of the Service after such changes constitutes your acceptance of the new Terms of Service. We encourage you to review this page periodically.
